These Terms of Service (“Terms”) govern reservations made through Ohana Vacations websites and booking experiences that link to these Terms, including reservations for inns, motels, hotels, vacation rentals, and other lodging accommodations.

By completing a reservation, including by clicking the button to finalize a booking, you agree to these Terms and to the reservation-specific price, payment conditions, cancellation policy, property rules, and other material conditions disclosed in connection with your reservation.

1. About Ohana Vacations and the Property

“Ohana Vacations,” “we,” “us,” and “our” refer to JBC VACATIONS INC., DBA Ohana Vacations, when acting in connection with the applicable reservation.

JBC Vacations provides reservation, management, property-management, and hospitality services for accommodations that may be independently owned or operated.

Depending on the accommodation, JBC Vacations may act as an owner, operator, manager, booking agent, or service provider on behalf of the applicable property owner or lodging operator.

The accommodations offered through a single booking website may therefore include both independently owned inns or motels and vacation rental properties subject to different property-specific terms, fees, and rules.

2. Agreement Governing Your Reservation

Your reservation is governed by:

These Terms;

The specific property or accommodation, dates, occupancy, price, taxes, fees, and other details shown for your booking;

The cancellation and refund policy applicable to your reservation or rate;

Any material property-specific terms disclosed in connection with your reservation; and

Reasonable operational and safety rules applicable to the property.

Not every term, fee, or property rule described in these Terms applies to every reservation.

A fee, restriction, or requirement that is specific to a particular type of accommodation applies only when applicable to and disclosed in connection with that reservation.

Reservation-specific terms control over conflicting general provisions of these Terms.

3. Eligibility and Responsibility

You must have legal capacity to enter into a binding agreement and satisfy applicable minimum-age requirements.

The person booking is responsible for:

Providing accurate information;

Making required payments;

Complying with these Terms;

Ensuring guests and visitors comply with applicable rules; and

Charges and obligations properly arising from the reservation.

4. Reservation Confirmation

A reservation is confirmed when confirmation is issued by us or the applicable booking platform.

Availability, rates, taxes, fees, restrictions, and policies may differ between inns, motels, vacation rentals, properties, dates, booking channels, and rate plans.

You are responsible for reviewing the reservation details before and after booking.

5. Rates, Taxes, and Fees

You agree to pay all rates, taxes, fees, and charges disclosed as applicable to your specific reservation.

Depending on the accommodation, charges may include:

Accommodation or lodging charges;

Applicable taxes;

Cleaning fees;

Pet fees;

Additional guest fees;

Parking, amenity, or property charges;

Transaction fees;

Damage waiver fees;

Deposits;

Optional services; and

Other charges disclosed before booking or separately authorized.

Not all fees listed above apply to every reservation.

Only fees applicable to the accommodation and reservation you select are chargeable.

Mandatory fees applicable to a reservation should be disclosed as part of the reservation pricing presented during the booking process.

Transaction Fee and Damage Waiver Fee

Certain vacation rental reservations may include a mandatory Transaction Fee and Damage Waiver Fee.

These fees apply only when they are disclosed as applicable to your specific reservation. They do not apply to every property or reservation offered through the booking website.

Where applicable:

The Transaction Fee and Damage Waiver Fee are included as part of the charges associated with the reservation;

Their applicability should be disclosed in the pricing or reservation details presented during booking;

Subject to the cancellation and refund policy applicable to the reservation and applicable law, these fees become fully earned and non-refundable upon commencement of the rental period; and

Completion of the stay does not create a right to a refund of these fees merely because no damage occurred, no damage-waiver claim was made, or the guest later submits a complaint or post-stay claim.

A post-stay complaint or dispute does not, by itself, make an otherwise properly charged Transaction Fee or Damage Waiver Fee refundable.

Nothing in this section limits a guest’s right to dispute a billing error, unauthorized charge, or exercise any right or remedy that cannot legally be waived.

Where a Damage Waiver Fee applies, it relates to the damage-waiver protection applicable to that reservation. Any applicable limits, exclusions, conditions, or additional damage-waiver terms disclosed for the reservation also apply.

6. Payment Authorization

By providing a payment method, you represent that you are authorized to use it.

You authorize Ohana Vacations, the applicable lodging provider, and applicable payment processors to charge the payment method for:

Amounts due at booking;

Scheduled or remaining payments;

Taxes and applicable disclosed fees;

Authorized changes, extensions, or services; and

Other amounts properly chargeable under these Terms.

Failure to make required payments may result in cancellation subject to the applicable reservation policy.

7. Cancellations, Changes, and Refunds

Each reservation is governed by the cancellation and refund policy disclosed for that reservation or rate.

Policies may differ significantly between accommodations and rate plans.

Unless applicable law or the specific reservation policy provides otherwise:

Cancellation after the applicable deadline may result in partial or complete forfeiture of amounts paid or due;

A no-show may be treated as a cancellation;

Early departure does not automatically create a right to a refund; and

Changes are subject to availability, current rates, and applicable policies.

Third-party booking platforms may impose additional procedures.

8. Property Unavailability

If accommodations become unavailable or materially unsuitable because of maintenance failure, damage, safety concerns, government restrictions, or other circumstances, reasonable remedies may include:

Alternative accommodations;

Different dates;

A mutually agreed credit;

Cancellation and refund of amounts paid for accommodations that cannot be provided; or

Another reasonable remedy.

Except where required by law, consequential expenses or losses resulting from circumstances outside reasonable control are not our responsibility.

9. Check-In and Checkout

Guests must comply with the check-in, access, and checkout procedures applicable to their accommodation.

Requirements may differ between staffed lodging properties and self-service vacation rentals.

Guests may not enter before authorized check-in without permission and must vacate by the applicable checkout time unless otherwise authorized.

Unauthorized early arrival or late departure may result in reasonable charges where disclosed or legally permitted.

10. Occupancy, Visitors, and Property Use

Guests must comply with occupancy limits and visitor rules applicable to the specific accommodation.

The primary guest is responsible for all persons associated with the reservation.

Unauthorized occupancy, parties, events, or visitors may result in charges, termination, or other lawful remedies when prohibited by the applicable property rules.

11. Property Rules and Guest Conduct

Guests must comply with rules applicable to the specific property.

Rules may address:

Smoking or vaping;

Pets;

Noise;

Visitors;

Parties and events;

Parking;

Occupancy;

Pools and hot tubs;

Fireplaces or fire features;

Trash;

Septic or utility restrictions;

Security and access;

Furniture and equipment; and

Other safety or operational requirements.

A rule that is relevant only to certain accommodations applies only where applicable.

Guests must treat properties, staff, contractors, other guests, neighbors, and communities with reasonable care and respect.

12. Refusal of Service or Termination

To the extent permitted by law, check-in may be refused or a stay terminated because of:

Fraud or material misrepresentation;

Failure to pay;

Serious or repeated rule violations;

Unauthorized occupancy, parties, or events;

Illegal or dangerous conduct;

Threats, harassment, or abuse;

Material property damage;

Unreasonable safety risks or substantial disturbances; or

Lawful orders requiring removal.

Refund eligibility depends on the circumstances, applicable law, and reservation-specific terms.

13. Damage, Excessive Cleaning, and Additional Charges

Guests are responsible for damage, loss, or extraordinary cleaning caused by the primary guest, members of the guest’s party, visitors, or animals associated with the reservation, beyond ordinary wear and tear.

Where permitted by law, reasonable charges may apply for:

Damage;

Missing property;

Excessive cleaning;

Unauthorized smoking;

Unauthorized pets;

Unauthorized parties or occupancy;

Lost access devices;

Charges or fines caused directly by guest violations; or

Other reasonably documented losses.

Any applicable damage waiver may limit financial responsibility for qualifying damage only according to the waiver terms applicable to that reservation.

A damage waiver does not necessarily cover all damage, conduct, losses, or violations.

14. Maintenance and Amenities

Properties vary significantly.

Temporary failures involving utilities, internet, appliances, pools, hot tubs, climate systems, or other amenities may occur.

Guests should promptly report significant problems and provide a reasonable opportunity to investigate and correct them.

Temporary amenity failure does not automatically create a right to a full refund.

Remedies depend on the nature, severity, duration, impact, ability to correct the issue, reservation terms, and applicable law.

15. Safety

Lodging properties may include features such as stairs, balconies, pools, hot tubs, fireplaces, parking areas, water, wildlife, natural terrain, or other conditions involving ordinary risks.

Guests must exercise reasonable care and appropriately supervise children and others requiring supervision.

Nothing in these Terms waives liability that cannot lawfully be waived.

16. Personal Property

Guests are responsible for safeguarding personal property.

To the fullest extent permitted by law, Ohana Vacations and applicable owners or lodging operators are not responsible for loss, theft, or damage to personal property except where liability cannot legally be excluded.

17. Events Beyond Reasonable Control

Neither Ohana Vacations nor applicable property owners or lodging operators are responsible for failure or delay caused by events beyond reasonable control, including severe weather, wildfire, flood, natural disaster, government action, widespread outages, transportation disruption, or public emergencies.

Available remedies depend on applicable reservation terms, circumstances, and law.

Travel insurance is encouraged where appropriate.

18. Third-Party Services

Properties and websites may interact with third-party booking platforms, payment processors, transportation providers, activity providers, telecommunications providers, and other independent businesses.

Unless expressly stated otherwise, independent third parties are responsible for their own products and services.

19. Communications

Reservation confirmations, receipts, policies, notices, disclosures, and transaction-related communications may be provided electronically.

You are responsible for providing accurate contact information.

20. Website Use and Intellectual Property

Websites may be used for lawful personal and travel-related purposes.

Unauthorized access, system interference, malware, fraud, impersonation, fraudulent reservations, and misuse of pricing or payment systems are prohibited.

Website content is owned by or licensed to applicable rights holders and protected by law.

21. Listing Information

Reasonable efforts are made to provide accurate property descriptions, photographs, pricing, availability, and other information.

Minor differences may result from maintenance, updates, replacement furnishings, seasonal conditions, or photography.

Material changes affecting confirmed reservations will be addressed in accordance with these Terms and applicable law.

22. Limitation of Liability

Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.

To the fullest extent permitted by law, Ohana Vacations, applicable owners and lodging operators, and their representatives will not be liable for indirect, incidental, special, or consequential losses arising from circumstances outside reasonable control, guest negligence or conduct, violation of these Terms, or misuse of accommodations.

These Terms do not limit liability for fraud, willful misconduct, or liability that applicable law prohibits from being waived.

23. Privacy

Our handling of personal information is described in our Privacy Policy.

24. Changes to These Terms

We may update these Terms prospectively.

The Terms applicable to a reservation generally will be the version presented or made available in connection with the reservation, together with applicable reservation-specific terms and policies.

25. Severability and No Waiver

If a provision is unenforceable, it will be enforced to the maximum lawful extent or severed, while remaining provisions continue in effect.

Failure to enforce a provision does not waive future enforcement.

26. Applicable Law

These Terms and reservations are subject to applicable federal, state, local, and, where appropriate, foreign law.

Applicable law may depend on the location and type of accommodation, the entity providing it, and other legally relevant circumstances.

Nothing in these Terms deprives consumers of mandatory legal protections.
